Guestly Terms of Service

These Terms of Service (“Terms”) govern access to and use of the Guestly platform, including the website, mobile applications, and all related services operated by Guestly (collectively, the “Platform”). These Terms form a legally binding agreement between Guestly and any individual or entity accessing or using the Platform (“you” or “user”).

By accessing, registering on, or using Guestly, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must not use the Platform.

1. About Guestly and its role

Guestly operates as an online technology marketplace that enables users to discover, list, and book accommodation services offered by independent third-party hosts. Guestly does not own, lease, manage, or operate any accommodation properties listed on the Platform. Guestly does not act as a hotel operator, property manager, travel agent, or real estate broker. Its role is limited to providing digital infrastructure for listing discovery, booking facilitation, payment processing, and platform communication.

2. Eligibility and account registration

To access or use Guestly, you must be at least eighteen years of age and legally capable of entering into a binding contract under Indian law. Users are required to provide accurate, current, and complete information during registration and to keep such information updated. Registration is permitted only using valid India-based mobile numbers. Guestly reserves the right to refuse registration, suspend accounts, or terminate access at its discretion.

3. User accounts and responsibilities

Users are responsible for maintaining the confidentiality of their account credentials and for all activities conducted through their account. Users must not create multiple accounts, impersonate others, provide false information, or allow unauthorized access. Guestly is not responsible for any loss or damage arising from unauthorized use of an account.

4. Bookings and contractual relationship

When a booking is confirmed through the Platform, a direct contractual relationship is formed exclusively between the guest and the host. Guestly is not a party to this accommodation agreement and does not assume responsibility for the performance of the stay, property condition, or the conduct of guests or hosts. Guestly’s involvement is limited to facilitating booking confirmation, payment collection, and platform-based communication.

5. Payments and platform use

All bookings and payments must be completed exclusively through the Guestly Platform. Users are prohibited from bypassing the Platform by making off-platform payments, engaging in direct bookings, or sharing external payment details. Guestly may charge service fees or commissions for use of the Platform, which are disclosed at the time of booking or listing.

6. Prohibited conduct

Users must not misuse the Platform or engage in conduct that is fraudulent, misleading, abusive, defamatory, discriminatory, unlawful, or harmful to Guestly or other users. Attempts to extract personal contact information, solicit off-platform transactions, interfere with platform security, or violate applicable laws are strictly prohibited. Guestly reserves the right to take appropriate action, including suspension or termination of accounts.

7. Suspension and termination

Guestly may suspend or terminate access to the Platform at any time, without prior notice, if it reasonably believes that a user has violated these Terms, engaged in fraudulent activity, or posed a risk to the Platform, other users, or Guestly’s business interests.

8. Intellectual property

All content, trademarks, logos, software, and platform features are owned by or licensed to Guestly and are protected under applicable intellectual property laws. Users are granted a limited right to access and use the Platform solely for its intended purpose. Unauthorized copying or use of Guestly’s intellectual property is prohibited.

9. Disclaimer and limitation of liability

The Platform is provided on an “as is” and “as available” basis. Guestly makes no guarantees regarding the accuracy, reliability, or availability of listings or services. To the maximum extent permitted by law, Guestly shall not be liable for indirect or consequential damages. Guestly’s total liability, if any, shall be limited to the platform fees received for the relevant booking.

10. Governing law

These Terms are governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of Indian courts.
